Definitions 

This “Agreement” means this Terms of Use, and includes the Privacy Policy and Refund Policy. 

“Channels” means mode of communication and dissemination for our Services such as but not limited to private Telegram Group, WhatsApp Group, Facebook Group Support. 

“Commencement Date” means the unique date where we shall announce to you, which is your first training date, and the start of your Utilization of our Services. 

“Services” means the services, materials and incidental products received from us, which are for informational, educational and/or training purposes. 

“Online Guru Trader Pte Ltd” and “We”means our Company. 

“Utilized” or “Utilization” means the User has either received Services/materials from us, or been allowed access to our channels or platforms (including third party platforms. 

Third Party Platforms

We recommend the use of Third Party platforms, however, your use of such platforms shall be subject to their respective terms of use, terms and conditions, privacy policy, etc (“their Terms”).

You, the User shall fully indemnify us, as per the Indemnity clause above, for any and all third party claims, Loss, liability, damages and/or costs (including but not limited to legal fees) arising out of or in connection with your use of any and all of the Third party platforms, or any breach of their Terms. 

Terms Of Use

User agrees that the Services appearing on or accessible to the user are for informational, educational and/or training purposes only. 

We may provide Services for User’s reference, including but not limited to materials and information, through Facebook, Telegram and WhatsApp.

By using the Services, including materials and incidental products received from us, which are for informational, educational and/or training purposes, you assume full responsibility for any and all gains and losses, financial, emotional or otherwise, experienced, suffered or incurred by you. 

• Restrict or inhibit any other visitor or member from using the Site, including, without limitation, by means of “hacking” or “cracking” or defacing any portion of any of the Site;
• Express or imply that any statements you make are endorsed by us, without our prior written consent;
• Use the Site for any unlawful purpose;
• Intentionally re-register for multiple free or paid trials to our services under different email addresses as a means to avoid paying for a given service. Our business requires substantial expenses to operate, including rentals, staffs salaries, technology-related costs and marketing expenses, among others. In order to cover these expenses, our services are made available only to fee-paid members and limited-time free or paid trial subscribers. By using our site, you agree to respect that fact and to not sign up for more than one free or paid trial;
• Transmit (a) any content or information that is unlawful, fraudulent, threatening, harassing, abusive, libellous, defamatory, obscene or otherwise objectionable, or infringes on our or any third party’s intellectual property or other rights; (b) any material, non-public information about forex, CFDs, futures, options, securities without the authorization to do so; (c) any trade secret of any third party; or (d) any advertisements, solicitations, chain letters, pyramid schemes, investment and/or trading opportunities, or other unsolicited commercial communication (except as otherwise expressly permitted by us); · Engage in spamming or flooding;
• Transmit any software or other materials that contain any virus, worm, time bomb, Trojan horse, or other harmful or disruptive component;
• Modify, adapt, sublicense, translate, sell, reverse engineer, de-compile or disassemble any portion of any of the Site;
• Remove any copyright, trademark, or other proprietary rights notices contained in the Site;
• Frame” or “mirror” any part of the Site without our prior written authorization;
• Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine,” or in any way reproduce or circumvent the navigational structure or presentation of the Sites or their contents;
• Harvest or collect information about Site visitors or members without their express consent; or
• Permit anyone else whose account or subscription was terminated or who has not registered or paid for our content to use any portion of the Site through your subscription, username or password.

Intellectual Property and Limitation of Use

All Materials and/or Services provided by us remains and/or shall be Online Guru Trader Pte Ltd’s copyright or intellectual property or its Information Providers or third party (as the case may be). 

User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Material and/or Services, information, data, software, products or services obtained from Online Guru Trader Pte Ltd via its various Channels. 

Registration To Our Site

To have access to our subscription or members-only sections of our web site, you must be or become a member. 

When and if you register to become a member, you agree to (a) provide accurate, current, and complete information about yourself as prompted by the appropriate registration form, and (b) to maintain and update your information to keep it accurate, current, and complete.

 You acknowledge that if any information provided by you is untrue, inaccurate, not current, or incomplete, we reserve the right to terminate this Agreement and your use of the Site.

Please note that by signing up for our free or paid trial service or free newsletter subscriptions, you agree to receive occasional mailings from us in the future regarding certain financial offers that may interest you. You can always opt-out from receiving these offers by simply clicking on the unsubscribe link located in each marketing email we send. 

As part of the registration process, you may also be asked to select a password. If you have reason to believe that your account is no longer secure, you must promptly change your password by updating your account information, and immediately notify us by visiting our Contact Us page.

YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR PASSWORD AND FOR ANY AND ALL ACTIVITIES (INCLUDING PURCHASES) THAT ARE CONDUCTED THROUGH YOUR ACCOUNT.

Termination

This Agreement shall remain effective until terminated in accordance with its terms. Online Guru Trader Pte Ltd may terminate this Agreement, and/or your access to and use of the Sites or any portion thereof, immediately, in the event we determine, in our sole discretion, that you have breached this Agreement. In addition, we reserve the right to terminate this Agreement without cause.

Submissions

By sending or transmitting to us creative suggestions, ideas, notes, concepts, information, or other materials (collectively, “Materials”), you grant us a worldwide, non-exclusive, sublicensable (through multiple tiers), assignable, royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale and import such Materials in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Materials

The Site may contain links to other Internet websites or resources. We neither control nor endorse such other websites, nor have we reviewed or approved any content that appears on such other websites. You acknowledge and agree that we shall not be held responsible for the legality, accuracy, or inappropriate nature of any content, advertising, products, services, or information located on or through any other websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such content.

Limitation of Liability

Neither Online Guru Trader Pte Ltd nor its affiliates, suppliers, advertisers, affiliates, or agents or sponsors are responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory arising out of or relating in any way to the sites and/or content contained on the sites, or any product or service purchased through the sites. Your sole remedy for dissatisfaction with the site and/or content contained within the site is to stop using the site. The sole and exclusive maximum liability to our company for all damages, losses, and causes of action (whether in contract, tort (including, without limitation, negligence), or otherwise) shall be the total amount paid by you, if any, to access the sites.

Indemnification

You agree to indemnify, defend and hold us, our officers, directors, employees, agents and representatives harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, including any violation of the Code of Conduct above; (b) any allegation that any materials that you submit to us or transmit to the Sites infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (c) your activities in connection with the Sites or any services related to the Sites.

Subscription Cancellation Policy

The following terms applies to any subscription based services including but not limited to:

Subscription Start Date

Upon complete registration for our programmes, any subscription based services included in the package will start on the day of registration. 

You have up to 2 business days to inform us if you wish to postpone the service. 

Renewal

All subscription-based services are subjected to auto-renewal unless otherwise stated. 

Your credit card information is saved by the payment gateway (NOT the company) for future renewals upon registration. The company has no access to your credit card information. 

You’ll receive at least 1 reminder regarding your subscription at least 2 weeks before the renewal date. 

If you do not inform us that you wish to continue your subscription, we will cancel your subscription automatically and you will not be charged for the next renewal. 

You must provide 5 full business days notice prior to your auto renewal for us to terminate your account and prevent any additional charges.

Cancellation

You may request for cancellation by contacting us directly using the contact information on this page and/or website.  

Please be advised that once you request a cancellation, if you do not specify to have your account continued, your account will be terminated upon your cancellation request to prevent any additional charges or misunderstandings.

“Money Back” Policy

Trade To Win Coaching Programme

The following terms are specifically for the “Trade To Win” Coaching Programme only from 1st March 2023 onwards. 

Due to the nature of trading and the unpredictable nature of the stock market, there are specific terms you need to meet in order to qualify for the money back policy. 

In order to qualify for the “money back” policy, you’re required to do the following:

• Attend all 3 days of the “Trade To Win” masterclass.You can only postpone the masterclass up to 2 times. 
• Pick a minimum of 10 stocks (out of the list of 150 stocks provided) 
• Make all the trades based on the Profit Signal on the selected stocks (as covered in the live masterclass)
• Over a period of 1 year (or 365 days) from the time you completed the “Trade To Win” masterclass. 
• All qualifying stock trades must:  
  • Follow the entry price, take profit, stop loss (as stated in the profit signal).  If any of the trades is not done with the stated entry price, take profit and stop loss, you will not qualify for the money back policy.  
  • Be taken with proper risk Management where you do not risk more than 2% of your portfolio with every trade. If you risk more than 2% of your portfolio for any trade, the money back policy is voided. 
• Trades must be completely and accurately recorded and documented.
  • All stock trades must be done under 1 brokerage account. 
  • All trades must be recorded In a trading journal provided in an excel sheet named “Trading History”.
  • You must disclose all brokerage transactions for trades covered in the trading journal. 
    • Disclosure of all brokerage transactions must be presented in printed form and
    • Directly to our staff member. You will be required to run through every trade covered under the money back policy.
  • Tabulation of profit and loss takes into account entry price, stop loss price and take profit price and does not include commission fees, exchange fees, regulator fees, or any other fees.
• If you meet the above terms and you're not profitable, you might qualify for the money back policy.  
• Online Guru Trader Pte Ltd reserves the right to reject any request for the money back policy.

“Refund” Policy

This is unrelated to our “Money Back” policy.

If you have utilized our Products and Services, at our discretion, we may determine that you are not eligible for a refund.

Not including our internal processing time, for credit card payments it may take 14 to 30 business days for a refund to show up on your credit card statement. 

We shall not refund any sum to you as a result of your late arrival to, non-attendance of or withdrawal from any of our training/ class/ session.

Any refund requests that are approved, an administrative fee of $1,000 or more will be charged, and you shall bear all bank and/or transaction charges related to the refund. 

Complaints Procedure

In the event a User wishes to complain about any aspect of Online Guru Trader Pte Ltd, the User should put his/her complaint in writing. In making such a complaint, the User should set out the facts and date and support the complaint with documents and print screens, and the conclusion that he/she has drawn from those facts, and why the user feels such an event warrants a complaint. 

The User should include their personal particulars, including name, address, phone number, email address, and complaints should be addressed to [email protected]

Online Guru Trader Pte Ltd will normally acknowledge the complaint within seven (7) working days, and where Online Guru Trader Pte Ltd needs to ask for further information, it may take longer to respond to the User’s complaint. 

Online Guru Trader Pte Ltd may not be able to help the User if the User’s complaint is subject to litigation or is pending before the courts. 

Online Guru Trader Pte Ltd will not investigate any complaint which is beyond the scope of this Agreement, including but not limited to any complaint concerning matters that do not relate to User(s), the Terms of Use, any other matter not related to these terms and conditions or any matter which is properly disposed of by any regulatory or dispute resolution body. 

If Online Guru Trader Pte Ltd considers that a complaint made by a User is vexatious or frivolous, Online Guru Trader Pte Ltd will advise the User complainant that no action will be taken. In addition the User shall bear all reasonable incidental expenses incurred by Online Guru Trader Pte Ltd in the investigation of such complaint(s). 

Privacy Policy

We collect information from you when you register on our site, place an order, subscribe to our newsletter or fill out a form.
